By registering as a member of Whānau Forum, you agree to be bound by these terms and conditions, and it is your responsibility to read and understand them.

1. Essential information about Māori Television

1.1 The Whānau Forum community, found at www.whanauforum.co.nz is run by Māori Television of 433 East Tamaki Road, East Tamaki, Auckland 2013, New Zealand ("we", "us", "our").

1.2 Membership of Whānau Forum is free. You may only join Whānau Forum once.

1.3 To join the community, you must be over 10 and have a personal email address.

1.4 If you no longer wish to receive emails about Whānau Forum, please unsubscribe here.

2. Data Protection and Privacy

2.1 By registering as a member of Whānau Forum, you consent to Māori Television and community managers, Buzz Channel holding, storing, processing, analysing and using the information you submit for market research purposes only. Your name and e-mail address will not be disclosed to any third party (apart from Māori Television's data management agents) without your permission. Personal information disclosed by you in the registration survey (your name, e-mail address, year of birth) will be stored securely, but by its nature will not be anonymous. If you do not wish Māori Television to use data submitted by you in this way, please do not apply to join the Whānau Forum community.

2.2 We will only deal with your personal information in accordance with Māori Television's Privacy Policy, which you can see  here, and these  Terms of use.

2.3 You can check the personal information that is held about you on the Whānau Forum community database, by e-mailing katie@whanauforum.co.nz

2.4 If you send an enquiry or request to the helpdesk which does not relate specifically to Whānau Forum community and would be better dealt with by another part of Māori Television (such as the Customer Services department), we will acknowledge receipt of your message and provide you with a more appropriate email address to use or forward it on to someone who can help you.

3. Security of your information

3.1 Māori Television takes all reasonable steps to ensure that all information it collects, uses or discloses is accurate and stored in a secure environment accessed only by authorised persons for legitimate business purposes.

4. Monitoring of telephone calls and e-mail

4.1 Your telephone calls and e-mails to us may be recorded and monitored for quality control purposes. We may also intercept communications made to individual members of staff at Māori Television and Buzz Channel when this is required for business purposes.

5. Destruction of your information

5.1 Māori Television takes all reasonable steps to ensure your personal information is disposed of once it is no longer needed for the purpose for which it was collected.

6. Access to your information

6.1 You may request an inspection, update or correction of the personal information we hold about you, or lodge a complaint, by writing to Māori Television's Privacy Officer at Māori Television Limited PO Box 64-341, East Tāmaki, Auckland 2163, New Zealand.

7. Communication

7.1 You can contact us by email at katie@whanauforum.co.nz. We will use the email address you have provided to us to contact you.

8. Participation in Whānau Forum

8.1 You may not copy, reproduce, republish, download, post, broadcast, transmit, make available to the public, or otherwise use this website content in any way except for your own personal, non-commercial use. You also agree not to adapt, alter or create a derivative work from any of this website content except for your own personal, non-commercial use. Any other use of this website content requires the prior written permission of Māori Television.

8.2 You agree to use this website only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of this website.

8.3 You undertake that all information you give in relation to the website will be as accurate as possible. Providing false information could lead to being disqualified from Whānau Forum.

9. Disclaimers and Limitation of Liability

9.1 The content of this website, including the information, names, images, pictures, logos and icons regarding or relating to Māori Television, its products and services, is provided "AS IS" and on an "IS AVAILABLE" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.

9.2 Under no circumstances will Māori Television be liable for any of the following losses or damage (whether such losses are foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of this website regardless of the form of action.

9.3 Māori Television does not warrant that functions contained in this website content will be uninterrupted or error free, that defects will be corrected, or that this website or the server that makes it available are free of viruses or bugs.

10. Intellectual Property

10.1 The names, images and logos identifying Māori Television are subject to copyright, design rights and trademarks of Māori Television. Nothing contained in these terms shall be construed as conferring any licence or right to use any trademark, patent, design right or copyright of Māori Television.

11. Contributions to Whānau Forum?

11.1 Where you are invited to submit any contribution to this website (including any text, photographs, graphics, video or audio), you agree, by submitting your contribution, to grant Māori Television a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in other works in any media now known or later developed for the full term of any rights that may exist in your contribution. If you do not want to grant to Māori Television the rights set out above, please do not submit your contribution to this website.

11.2 Further to paragraph 11.1, by submitting your contribution to this website, you warrant that your contribution: is your own original work and that you have the right to make it available to Māori Television for all the purposes specified above; is not defamatory; and does not infringe any law. You indemnify Māori Television against all legal fees, damages and other expenses that may be incurred by Māori Television as a result of your breach of this warranty, and waive any moral rights in your contribution for the purposes of its submission to and publication on this website and the purposes specified above.

11.3 You agree not to use this website in any way that is illegal or causes damage or harm to us or others. This includes (but is not limited to):

  • sending unsolicited electronic mail to any person for the purpose of advertising or promoting any organisation (spamming);
  • infringing our, or any other party's, intellectual property rights, including by distributing copyright material;
  • using or distributing the personal information of others in any way without their consent;
  • using the website in any way that is offensive to others, including using inappropriate language or expressions of bigotry or hatred;
  • engaging in harassment, whether through language, frequency, or size of messages
  • attempting to gain unauthorised access to any system, network or account belonging to us or another person (hacking);
  • attempting to intercept, interfere with or deny the website to any another person;
  • introducing or sending anything harmful or destructive (such as viruses, worms, Trojan Horses, time bombs or bots) to our or anyone else's computer system or communications services;
  • engaging in any fraudulent activity, such as the use of a false identity, hiding the source of the message, or making the source appear to be someone else; and
  • using the website in any way that encourages another person to breach the prohibitions covered under these Terms of use.

11.4 If we feel that you or any of your customers have breached these terms and conditions, we may immediately suspend or terminate your membership of the Whānau Forum community, without any notice or liability to you.

12. Market research activities within the community

12.1 The answers you give us will be treated as confidential unless you have given your consent to the contrary. We will not send you unsolicited mail or pass on your e-mail address to others for this purpose.

12.2 As with all forms of marketing and opinion research, your cooperation is voluntary at all times. No personal information is sought from or about you, without your prior knowledge and agreement. You are entitled at any stage of completing a survey, or subsequently, to ask that part or all of the record of your survey be destroyed or deleted. Wherever reasonable and practical, we will carry out such a request. Māori Television and Buzz Channel will not knowingly send e-mails to people who have not consented to being part of the Whānau Forum community. If you no longer wish to receive emails from Māori Television and Buzz Channel about the Whānau Forum community, please "unsubscribe"here.

13. Security Techniques

13.1 We have used a unique URL system which allows you to stop any survey half way through and then link again from your email invite or via the 'Members Zone' page to join the survey at the place where you left off. The storage of any information that has been entered by you before you have completed the full survey is held on a secure server.

13.2 We use cookies and other similar devices sparingly and only for quality control, validation and to prevent bothersome repeat surveying. You can configure your browser to notify you when cookies are being placed on your computer. You can also delete cookies by adjusting your browser settings.

13.3 Our website has security measures in place to protect the loss, misuse, and alteration of the information under our control. Only authorised employees have access to the information you provide us. They have access only for data analysis and quality control purposes.

14. Personal Details

14.1 Personal information disclosed by you in the registration and the details given in surveys (your name, e-mail address, year of birth) will be stored securely, but by its nature will not be anonymous.

14.2 If you update your personal details on this site, these changes will be made to your community registration records only, and will not be disclosed to another part of Māori Television, for example the customer database. If you wish to check or update the personal information that is held about you on the Whānau Forum community database, please click  here.

14.3 If you wish to check the personal information that is held about you on the community database, you can do so at any time by e-mailing katie@whanauforum.co.nz.

14.4 As with all market research conducted by Māori Television, the Market Research New Zealand's Code of Practice (http://www.mrsnz.org.nz/Resources/Code-of-Practice-2008.asp).

15. Why we collect personal information

15.1 We collect personal information for the following purposes:

  • to keep you informed and obtain your views on Māori Television's products, services and activities;
  • to create a database of individuals willing to take part in research and surveys for Māori Television;
  • to evaluate which individuals registered with Whānau Forum should be approached in respect of surveys being conducted;
  • to provide you with information about benefits given to you by Māori Television as a result of your responding to survey requests;
  • to process the answers to surveys and summarise the results;
  • to transfer to service suppliers who undertake processing on our behalf and at our direction;
  • to administer your membership of Whānau Forum;
  • to process any enquiries raised by you and other communications initiated by you in relation to your dealings with Whānau Forum; and
  • contacting you by email to invite you to take part in surveys and when permitted by you, to send you electronic marketing communications keeping you informed about the activities of Whānau Forum.

16. Changes to and termination of Whānau Forum

16.1 We may make changes to the Whānau Forum website. We will tell you about these by email.

16.2 If you do not participate in 3 consecutive surveys we may terminate your membership of the Whānau Forum community.

17. Prize draws

17.1 As a member of Whānau Forum you may be entered into regular prize draws for participating in the community forums and completing surveys. Māori Television reserves the right to open, suspend or terminate such draws at any time without prior notice. For each draw, we will state the conditions of entry, prize available, dates competition is available for and date the prize will be drawn.

Māori Television reserves the right to update these terms and conditions from time to time by posting an updated version on the Whānau Forum website. Your continued use of the Whānau Forum website after we post any such changes indicates your acceptance of those changes.
